Roe v. Wade Overturned by SCOTUS, Leaked Document Indicates

The Supreme Court of the United States will overturn Roe v. Wade, according to a leaked document provided to Politico.

Justice Samual Alito wrote the majority opinion in the 98-page document deciding Dobbs vs. Jackson Women’s Health Organization.

The case challenges Mississippi’s 15-week abortion ban.

This is the first pending Supreme Court decision leaked in modern history. Justice John Roberts confirmed its authenticity on the morning of Tues., May 2.

However, the court could still change their decision since the document is a draft.

Five justices voted with Alito and three dissented. Justice Roberts did not vote yet, according to the report. The court may release the final report in June.

Here’s some quotes from Alito’s alleged majority opinion:

“We hold that Roe v. Wade must be overruled. The Constitution makes no reference to abortion, and no such right is implicitly protected by any constitutional provision…”

“Roe was egregiously wrong from the start. Its reasoning was exceptionally weak, and the decision has had damaging consequences. And far from bringing about a national settlement of the abortion issue, Roe and Casey have enflamed debate and deepened division. It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives.”

This Court cannot bring about the permanent resolution of a rancorous national controversy simply by dictating a settlement and telling the people to move on. Whatever influence the Court may have on public attitudes must stem from the strength of our opinions, not an attempt to exercise ‘raw judicial power.’”

“Roe’s defenders characterize the abortion right as similar to the rights recognized in past decisions involving matters such as intimate sexual relations, contraception, and marriage, but abortion is fundamentally different, as both Roe and Casey acknowledged, because it destroys what those decisions called “fetal life” and what the law now before us describes as an “unborn human being.”
